SPECIAL TERMS AND CONDITIONS FOR CONTEST « VIP Pass – 10 Years IQOS Event »FOR IQOS CLUB MEMBERS

SPECIAL TERMS

1. Contest Duration

The duration of the Contest is defined as the period from June 28, 2024, until July 10, 2024. It is expressly specified that, after the end of the Contest, entries are automatically invalid. To select the winners, a lottery will be held among the participants, as defined in par. 6.1 of the TERMS AND CONDITIONS OF COMPETITIONS FOR IQOS CLUB MEMBERS.

2. Conditions for participation in the Contest

2.1 To participate in the Contest, the participant must visit IQOS CLUB in the "privileges" category, activate the corresponding coupon of the contest and to accept the present SPECIAL TERMS AND CONDITIONS FOR CONTEST «VIP Pass – 10 Years IQOS Event» FOR IQOS CLUB MEMBERS and the TERMS AND CONDITIONS OF PARTICIPATION IN THE EVENT "TogetherX Karaoke Contest 2024".

3. Winners and Alternatives Winners

It’s been specified that during the competition the following will be selected

- Fifty (50) Winners and Fifty (50) alternate winners that will participate as audience for the July 18th song contest.

4. Contest Awards

- The Fifty (50) winners selected from the draw are eligible to participate as an audience in the song contest that will take place on July 18th with another adult friend.

The draw will take place within (5) business days from the end of the contest and winners will be informed by phone as defined in par. 6.2 of the TERMS AND CONDITIONS OF COMPETITIONS FOR IQOS CLUB MEMBERS.

5. Acceptance of Prize

After the winners have been selected, the winners will be contacted to claim the prize within three (3) days to the details they have provided on iqos.com.

6. General Provisions

These Special Terms and Conditions apply in addition to the Terms and Conditions of competitions for IQOS CLUB members.

This agreement sets out the terms and conditions that apply to my attendance at and/or my involvement in (“Participation,” and “Participate” shall be interpreted accordingly) the TOGETHERX KARAOKE CONTEST 2024 (the “Event”) as audience, organized by Philip Morris Cyprus (“PM”). The Event will take place in Limassol, Cyprus on July 18th, 2024.

In case I am selected to participate in the Event, according to Special Terms and Conditions for Contest «TOGETHERX KARAOKE CONTEST 2024» (“Special Terms”) and in consideration for being permitted to Participate in the Event as audience, I agree as follows:

Publicity release

1. I acknowledge that PM will take photos and videos of the Event, in which I will/may appear, without, however, being able to be identified.

2. I agree that PM and its affiliates (i.e. any entity which controls, is controlled by or is under common control with PM) shall have:

2.1. full, unfettered rights to: (i) use my image and likeness in respect of all communication and publicity material made in connection with the Event; and (ii) record and film my Participation at or in connection with the Event (whether by audio or audio-visual means or howsoever) and take photographs of my Participation at or in connection with the Event, and in each case use such footage in respect of any communication and publicity material made in connection with the Event, (the material referred to in (i) and (ii) above shall collectively be referred to as the “Material”);

2.2. the exclusive rights to use the Material (only in connection with the Event) in any and all manner through IQOS CLUB and/or internally at PMI, without being liable to me for any type of payment or compensation, and I agree that the Material shall at all times remain PM’s sole property and that I will have no right, title or interest in or to it, or any part thereof, or in respect of any proceeds from it. In relation to the processing of my personal data, shall be the performance of this contract set out in these Terms. PM may share the Material with other PM affiliates worldwide for them to use it internally.

2.3. the right to make alterations and edits to the Material as they deem appropriate, including without limitation the right to use any of the Material in whole or in part or in composite or distorted character or form, where such treatment is not a derogatory treatment or distortion of the Material. Such alterations and edits to the Material shall be only in relation to the Event.

3. I undertake that I shall not use any Materials, pictures or any items provided to me in connection with the Event, other than for private non-commercial purposes and for the purpose for which they were provided to me.

4. I irrevocably and unconditionally waive, to the fullest extent permitted by law, all moral rights (and their equivalent in any jurisdiction of the world to which I may be entitled under any law now or in the future in force) in respect of the inclusion, alteration and/or exploitation of any of the Material.

Data protection and privacy notice

5. To Participate in the Event as audience, I acknowledge that I have already accepted the Terms & Conditions of being a registered consumer and an IQOS CLUB member. I acknowledge as well that my personal data are collected and processed in accordance with the applicable consumer privacy policy.

6. We inform you that the data related to the Participation in the Event, including your name, surname, contact details, this agreement and any other document relating to the Participation in the Event, your country of residence, biographical information that you may freely provide, images, downloads, and audio/video recordings, even in partial and/or modified or adapted form, created during the Event will be processed in full compliance with the GDPR. Personal data will be processed by Philip Morris Cyprus, as Data Controller, respecting the principles of legality, fairness, and transparency. This data will be stored and processed only for the purpose of the Participation in the Event, for the purpose of using the Material, keeping a record of the correct implementation of the Event, and being able to contact participants in the future in relation to the Event. The data will be kept for a period strictly necessary to achieve the intended purposes. The downloads collected will be kept also in electronic form and by any technological means for the purposes of use and in a way that guarantees security and protects the maximum confidentiality of the interested party. Special security measures are taken to prevent data loss, illegal or improper use, and unauthorized access in full compliance with Article 32 of the GDPR. Access to the acquired data will only be allowed to personnel duly authorized for processing under Article 29 of the GDPR. The data processed will also be accessible to any companies undertaking the assembly work that will perform the function of the Processor in accordance with the provisions and effects of Article 28 of the GDPR. Personal data will be processed by the Data Controller within the territory of the European Union. We may share the processing data with other subsidiaries of Philip Morris International, for example, with Philip Morris Products S.A. (based in Neuchatel, Switzerland), or any other Philip Morris International affiliates, in the event that they wish to contact you to invite you to participate in further similar events. If it is deemed necessary to use entities located outside the European Union, or it is necessary to transfer some of the collected data to technical systems and services managed in the cloud and located outside the territory of the European Union, the processing will be regulated in accordance with the provisions of Chapter V of the GDPR to ensure adequate protection of your personal data, ensuring that the personal data is protected by technical and organizational measures designed to keep it secure and to protect it from unauthorized processing.
