IQOS CLUB General Terms and Conditions ("General Terms")
General Terms of participation in the IQOS CLUB program
1. General provisions
1.1. These General Terms govern the relationship between PHILIP MORRIS CYPRUS LTD, and the members of the IQOS CLUB program.
1.2. IQOS CLUB is a customer loyalty program, in which IQOS CLUB Members may participate for as long as they wish in order to collect Points by performing specific actions and in return receive Privileges corresponding to the Level achieved through the Points they collect.
1.3. Each IQOS CLUB Member must carefully read and accept these General Terms and Conditions when registering to participate in the IQOS CLUB. Members agree to comply with the General Terms and Conditions of the IQOS CLUB program during their membership. In case of disagreement (or inability to comply with the General Terms and Conditions), Members may terminate their participation at any time directly from their account or by contacting the Customer Service Centre at the email address: contact.cy@iqos.com or at the toll free phone number: 800 088 03
2. Organiser
2.1. The organiser of the IQOS CLUB program is PHILIP MORRIS CYPRUS LTD, with its registered office at Kennedy 23, 1075, Nicosia, Cyprus, registration number HE420512 (hereinafter "PMCY"). The IQOS CLUB program is available at cy.iqos.com.
3. Territory
3.1. The IQOS CLUB program is implemented within the territory of the Republic of Cyprus.
4. Definitions
4.1 The"IQOS CLUB" is a customer loyalty program as defined under term 1.2 above..
4.2 "Accessory" means an accessory designed for use with a Device, including, without limitation: cover, case, mobile charger, car charger, car mount, receptacles and other accessories for the Device. To avoid confusion, Device cleaning sticks and Device cleaning devices are not Accessories.
4.3 "General Terms and Conditions" means these general terms and conditions governing the IQOS CLUB program.
4.4 4.4 "Trader" means the distributor of Philip Morris International products, i.e. the company named Cassandra Trading Limited (hereinafter referred to as "Cassandra"), and the traders who offer PMI products for sale.
4.5 "Actions for which Points are earned" has the meaning specified under term 6 of these General Terms and Conditions.
4.6 "Level" depends on the number of Points earned during a specified period of time and shall be achieved in accordance with the criteria specified under term 7 of these General Terms and Conditions.
4.7 "Registration Date" means the date on which the Member registers in the IQOS CLUB having accepted these General Terms and Conditions.
4.8 "Customer Service Centre" means the customer service contact centre for PMI Products. .
4.9 "Member of the IQOS CLUB" or "Member" means a natural person who meets all of the following conditions:
- is over 18 years of age and has been verified as an adult;
- resides in the Republic of Cyprus;
- has an active user account on cy.iqos.com;
- has at least one device registered in the PHILIP MORRIS Adult Consumer Database at iqos.com;
- has accepted these General Terms and Conditions.
4.10 "Points" are Points collected by Members for specified actions for which Points are earned and through which Members achieve specified Levels in the IQOS CLUB.
4.11 " PMIProducts" means the Devices and Accessories of Philip Morris International Devices which are imported and distributed in the Republic of Cyprus by the partners and/or agents of PM Cyprus and/or Philip Morris International.
4.12 "Privileges" has the meaning specified in the relevant term of these General Terms and Conditions.
4.13 "Partner" or "IQOS CLUB Partner" means any natural or legal person who provides special benefits (i.e. coupons) to IQOS CLUB Members.
4.14 "Device" means any smoke heating device with built-in advanced technology, branded IQOS or lil.
5. Registration
5.1. Only persons who meet the conditions set out under the definition of the term ‘Members’ in term 4.9 above and who have accepted these General Terms and Conditions, which they are asked to read carefully first, are eligible to participate in the program and to register as IQOS CLUB Members. Participation in the IQOS CLUB is voluntary and personal.
5.2. In order to register in the IQOS CLUB you must (1) login to your account at cy.iqos.com, (2) select IQOS CLUB login and (3) accept the IQOS CLUB General Terms and Conditions.
5.3. Each Member is responsible for the use of their user name and password, which they must not disclose to third parties.
5.4. It is the responsibility of the Members to declare correct and true details to PMCY when registering in the IQOS CLUB. In the event of a change to a Member's details, the Member must update their details on the IQOS CLUB website and/or cy.iqos.com ("Website").
5.5. You accept that the above information will be used to identify you for the purposes of verifying you as an adult, applying the terms of the IQOS CLUB and accessing your account in the IQOS CLUB, as well as providing you with your Privileges and the Points you are entitled to and any Announcements for the purposes of the IQOS CLUB. When you change the mobile telephone number included in your details, you will be identified using the new mobile telephone number you have declared. PMCY is not liable if, due to incorrect information, PMCY is unable to apply the terms of the IQOS CLUB and/or to verify you are an adult and/or to grant you the Privileges you are entitled to.
5.6. PMCY is entitled, without being obliged to do so, to check that the conditions for obtaining the status of Member in the IQOS CLUB, as well as the identification information of the Member, are still valid, at any time during membership. PMCY reserves the right to refuse to activate the Member's account or to terminate access to it (provisionally or permanently), or to terminate the Member's participation in the IQOS CLUB, when it has reasonable suspicions or has established, at its discretion, that the Member does not meet the conditions set out in term 4.9 above or violates the present terms of the IQOS CLUB or its individual programs, without being subject to the obligation to observe a deadline or to compensate such Member.
5.7. The nature of the IQOS CLUB Membership, as well as the services and Privileges provided in the context of the IQOS CLUB program, is not transferable to third parties.
6. Points and Actions
6.1. Each IQOS CLUB Member may earn Points for the following actions:

6.2. At its discretion, PMCY may at any time change the rules and methods for obtaining Points, notifying Members by a relevant post on IQOS CLUB.
6.3. Points cannot be transferred to another Member or to third parties.
6.4. Points cannot be transferred to another Member or to third parties.
6.5. Points cannot be used in any way other than to achieve a Level in the IQOS CLUB. Points have no monetary equivalent and cannot be redeemed for monetary amounts.
6.6. In the event of a dispute regarding the Points credited, PMCY may request the relevant Member to provide a receipt and/or any relevant supporting document for the action for which the Member claims to be entitled to receive Points. All claims concerning the non-receipt of Points or the receipt of fewer Points must be submitted within six (6) months and, in any case, within one calendar year from the performance of the respective action.

7. Levels
7.1. The IQOS CLUB has three Levels:
- SILVER – basic level achieved by registering to participate (0-1,499 Points);
- GOLD – 1,500 to 2,499 Points; and
- PLATINUM – over 2,500 Points
The Privileges that IQOS CLUB Members are entitled to are based on the Level they are in.
7.2. Members automatically become SILVER level Members on registration.
7.3. The number of Points a Member accumulates within a calendar year determine the Member's IQOS CLUB Level, with the exception of the year 2023, where the point collection period ends at the end of the following calendar year (2024). When any Member accumulates the number of Points required to move up to the next Level, the Member will automatically be moved up to that Level.
7.4. The transition to the next Level is carried out in the following order: SILVER to GOLD, GOLD to PLATINUM, depending on the number of Points accumulated within a calendar year, without prejudice to Article 7.3.
7.5. For each member, their Points will be added to such Member’s account from the date of registration until the end of the calendar year. At the end of each calendar year, each Member's Points are reset to zero, the such Member's Level is maintained based on the number of Points accumulated by the Member during the previous calendar year. The year 2023 is an exception, where the point collection period ends at the end of the next calendar year, as stated under Article 7.3.
For example, if a Member has registered on 01.04.2023 and by 31.12.2024 the Member has accumulated 2,500 Points and achieved PLATINUM Level,on 1.1.2025 these Points will be reset to zero, but for the entire year 2025 the Member will remain a PLATINUM Level Member. If during 2025 the above Member accumulates less than 1,500 points, they will be moved to the SILVER level in 2026.
7.6. At its discretion, PMCY may change the number of Points required for each Level at any time, posting the changes on IQOS CLUB and/or notifying Members by email.
7.7. PMCY receives, stores and processes your personal data in connection with the management of the IQOS CLUB program and your participation in it. It is noted that, PMCY will only send commercial communication messages to IQOS Members who have agreed to receive commercial communication messages on cy.iqos.com. If Privileges are changed, the corresponding page on the IQOS CLUB will be updated accordingly.
8.2. Members may obtain the above Privileges by accumulating Points and achieving the corresponding Level. Each Member’s ability to use the Privileges depends on availability in the respective sales outlet or online store.
8.3. Only the Member who is entitled to the respective Privilege based on the Level that Member has achieved can receive that Privilege.
8.4. Privileges
8.4.1. Discounts on Devices
For Privileges corresponding to discounts on Devices and Accessories, after the specific Privilege is requested by the Member who is entitled to it based on the Member’s Level, PMCY will send an individual one-time discount code, which Members receive in their account. The discount code can only be redeemed at IQOS Stores and on the IQOS online store after the relevant code has been received by the respective Member in their account.
8.4.2. Special benefits provided by Partners for IQOS CLUB Members ("coupons").
i) Each IQOS CLUB Member may benefit from special privileges specified and provided by Partners, information about which will be published in the "Privileges" section of the IQOS CLUB Website. For this purpose, the Member must request a coupon for the benefit desired using the relevant sub-section on the IQOS CLUB Website for the Partner in question. The requested code is obtained via email and can be found in the "My Privileges" section of the IQOS CLUB.
ii ) The period of validity of a coupon will be identical to the period of validity of the Partner's coupon which is indicated in the special terms and conditions of the respective Partner's coupon and which will be posted on the IQOS CLUB. Coupons pertaining to one Partner cannot be used to obtain benefits from another Partner.
iii) If an IQOS CLUB Member wishes to take advantage of a special benefit offered by a Partner, the Member must, prior to completing the purchase at that Partner's store, provide the Partner with a valid code (i.e. voucher) which the member requests as described above. The validity of each code will be verified by the Partner.
iv) These coupons for IQOS CLUB Members are redeemed by the Partners, who are responsible for redeeming them. PMCY will make reasonable efforts to ensure the availability of such coupons, but will not be liable for any loss caused by any third party's inability to redeem the coupons. In such event, PMCY’s liability will be limited to the monetary value of the corresponding unused coupon.
8.4.3. All coupons are personal, and the respective IQOS CLUB Members are not entitled to assign them to others.

8.5. Members may only benefit from the Privileges while they are at the respective Level or, as the case may be, within the period specified for the Privilege. Coupons received but not used will be valid until their expiry date.
8.6.a. PMCY may unilaterally modify the Privileges and will inform Members of the new Privileges by email and/or by posting on the IQOS CLUB.
8.6.b. From time to time, PMCY will organise events exclusively for Members (competitions, etc.). The right to participate in such activities will be deemed as a Privilege, in accordance with the provisions of term 8.1. PMCY will inform Members by e-mail and/or by a relevant post on the IQOS CLUB about the organisation of such actions. Such messages will only be sent to Members belonging to the Level to which the relevant action is available.
8.8. PMCY reserves the right to: (i) terminate its relationship with Traders, Partners and other third parties, and thereby access to the Privileges associated with such parties, at any time and for any reason whatsoever and/or to enter into new partnerships regarding the Privileges with third-party Traders and/or Partners, and (ii) to modify the Privileges at any time and for any reason whatsoever. PMCY will notify Members of these changes.
8.9. Members who have received a coupon or voucher may benefit from the relevant coupons or vouchers during their period of validity pursuant to the terms under which they were received, regardless of whether the privilege has expired or has been modified by a subsequent amendment to the present General Terms and Conditions.
9. Account term and termination – Account deletion and IQOS CLUB Member account “Inactivity” period
9.1. Deletion at the Member's request
a) Members may unsubscribe from the IQOS CLUB at any time by contacting the Customer Service Centre (email address: contact.cy@iqos.com), by calling toll-free telephone number: 800 088 03) or by visiting an IQOS store or in other ways that will be announced from time to time.
b) In the event of a deletion request, the Member's account will be placed in an "Inactive" and "Warning" state for a period of seven (7) months in total, unless the Member expressly requests that it is deleted immediately. During this period, the Member will not have access to the IQOS CLUB and will not be able to redeem Privileges and coupons, and the Member will no longer be able to collect Points and will not be able to participate in Competitions.
c) Consequences of deletion:
i) Upon notification of the deletion request, the Member's participation in any program or any Privilege only available to CLUB Members will be terminated.
ii) Participation in any programs that someone may register in or remain in, even if not a CLUB Member, will continue to be active based on the more specific terms and restrictions applicable to each Program. In case of the Member's participation in competitions, such participation is immediately terminated.
iii) After the expiration of both the "inactivity" period and the "warning" period, all Points collected, as well as all coupons already issued to the Member and still within the redemption period, will automatically be cancelled and set to zero, and the Member’s access to their account will be permanently terminated, the account will be deleted and the data contained therein will be deleted. Deleted Members have no claims against PMCY and PMCY is not liable for compensation due to the above reason.
d) If the former Member wishes to become a CLUB Member again, the former Member must complete the registration and account activation procedure from the start, as described under term 5.2. In such a case, if the ``inactivity'' and ``warning'' periods, as described in term 9.2.1 have not expired yet, such Member will return to the account status applicable before the deletion request and term 7.5 will be understood to apply. If the <
> and <> periods have expired, then the provisions of term 9.2.1c apply. Members who, after losing their status as Members, re-register in the IQOS CLUB, will not be entitled to receive the Points that were accumulated in that Member’s account before the termination of their membership.
9.2. << Inactivity >> and << Warning >> Periods
a) In the event that a Member has not undertaken any action in the IQOS CLUB to collect Points for a period of 6 months (<< inactivity period >>), then the << warning >> period will begin and will have a duration of one month.
b) If during the << warning >> period the Member undertakes any action in the IQOS CLUB to collect Points, then the Member will retail membership of the IQOS CLUB.
c) If during the << warning >> period the Member fails to undertake any action in the IQOS CLUB to collect Points, then the Member loses their membership of the IQOS CLUB. In this case, term 9.1.c.iii applies. Should the former Member wish to become a IQOS CLUB Member again, the former Member must complete the registration and account activation procedure from the start, as described under term 5.2.
9.3 Deletion of an IQOS CLUB Member upon initiative of PMCY
9.3.1. PMCY is entitled to refuse the creation of an account and/or delete any Member for any reason related to that Member's illegal or non-contractual act or omission. In particular (without limitation), it is entitled to proceed to the aforementioned if there are indications of bad faith, illegal or non-contractual use of the account or non-compliance with these terms during participation in the IQOS CLUB and its programs or during the use of Privileges or the coupon redemption process etc. PMCY is also entitled to delete Members' accounts for reasons of force majeure such as, without limitation, any statutory or other prohibition.
9.3.2. In this case, the Member's account enters a state of "Inactivity" and "Warning" for a total of seven (7) months. During such period, the Member does not have access to the IQOS CLUB nor will the member be able to redeem Privileges, or to collect Points any more. Also, the Member’s Points are zeroed and the coupons issued to that Member which are still valid etc. are canceled as mentioned in 9.1.c) above. In this case, only the Member's personal information may be retained if necessary for the purpose of confirming that the same Member is not creating an IQOS CLUB account again. Furthermore, PMCY reserves the right to completely delete the information on this specific person from the PMCY consumer base, as well as the Member’s participation in other programs and actions by PMCY, while also reserving the right to compensation for any damage incurred due to the aforementioned behavior of the Member. Deleted Members do not have any claims against PMCY and PMCY is not liable for compensation towards any such Member.
9.4. Deletion due to discontinuation of the IQOS CLUB.
In the event that PMCY discontinues the IQOS CLUB at its discretion, it will inform the Members thereof by a notice and/or will individually set a reasonable period for the termination of the IQOS CLUB, which cannot be less than 30 days (unless the termination is due to reasons of force majeure, as mentioned above). During said period, the Member's account will enter into a "warning" status as set out under 9.2 leading to the consequences of deletion specified under term 9.1.c) above, and each Member will have the opportunity to redeem the available coupons/Privileges that correspond to that Member’s Level, within the period stipulated, regardless of the coupon's expiry date. Also, all Programs that require CLUB membership will be terminated.
9.5. Members are entitled to withdraw their consent to receive commercial messages from PMCY on cy.iqos.com; it is hereby clarified that such withdrawal of consent does not exclude these Members from participating in the IQOS CLUB program.
10. Liability
10.1. Members are fully and exclusively liable for any action (act or omission) performed through their account. PMCY is not liable to you or to any third party for damages due to any violation of the terms of the IQOS CLUB or the law, as long as they are caused by your culpable act or omission or, in any case, by your failure to inform us in good time and we reserve the right to take action against you or against any third party causing any damage to PMCY due to or arising from the aforementioned, as well as due to any failure on your part to assist or to provide information about the burden of proof you are subject to in relation to your obligation to provide accurate information and to properly send the discount code (coupon) to third parties. Moreover, PMCY is not liable for damages arising from the use of the IQOS CLUB as a whole (even towards any third party), caused by unauthorized access or use of the Member's account due to the Member's own fault, as long as such Member has not previously informed PMCY accordingly using PMCY’s contact details. It is noted that any action undertaken through the Member's account before informing PMCY, shall be reasonably considered by PMCY to be an action of the respective Member. PMCY is not liable for any damage, delay, injury or loss arising from or in connection with the participation in the IQOS CLUB, unless and to the extent that such loss or damage is due to PMCY's negligence or is caused by PMCY's fault or any unreasonable behaviour on the part PMCY while being aware of the possibility of this causing damage.
10.2. Regarding redemption of the coupons, PMCY or the Partners have no obligation whatsoever to you in the context of the IQOS CLUB, other than to undertake the provisions of the relevant coupon pursuant to its respective terms.
10.3. PMCY makes every effort to ensure that your data in relation to the IQOS CLUB are true and accurate and up-to-date, but is not liable for any error that may occur during the display of these data or for the suitability or timeliness of updates to you. In particular, PMCY is not liable for the accuracy of data regarding coupons that you have used to obtain products or services from our Partners, and for any discrepancy you should contact our Partners directly.
10.4. In relation to your purchases from Partners and/or Merchants or the receipt of products or services from them in the context of redeeming coupons and/or using IQOS CLUB Privileges, PMCY are not liable in relation to the quality, suitability, compliance with the law, agreed properties and actual or legal defects of the products or services of the Partners and/or Traders. You should contact the relevant Partner about any issue arising due to or from the aforementioned.
10.5. Except as expressly stipulated under these General Terms and Conditions, PMCY is not liable for any loss or damage arising as a result of the termination or modification of the IQOS CLUB Program or the withdrawal of its Partners or Traders from the Program. PMCY will exercise reasonable efforts to notify Members of such modifications or withdrawals as soon as possible.
10.6. PMCY is not liable if a Member does not take advantage of a Privilege to which that Member is entitled to within its term, as stipulated under these General Terms and Conditions. PMCY is not liable if the stock of the products and/or services offered as a Privilege at Trader and/or Partner stores is exhausted.
11. Use of the IQOS CLUB Website and its Materials
11.1 The IQOS CLUB Website is the property of PMCY and is protected by Cypriot copyright and trademark laws. Any attempt to alter the appearance and information of the IQOS CLUB or to create mirror copies of the Website without the prior consent of PMCY is prohibited and entitles PMCY to apply to the competent court to seek compensation for any damage incurred due to such infringement.
11.2. Any unauthorized use of the Website and in particular: (i) any use of the Website for commercial purposes or otherwise for a use which is different than the intended use of the Website and (ii) any statement, transfer, communication, distribution, modification, licensing, sale or other action for the purpose of misusing the Website, its content, text or parts thereof or still or moving images, audio data, products or other data or information, is prohibited without the prior written consent of PMCY.
11.3. When Members access, use and download content from the Website, they do so at own risk and own responsibility. Therefore, PMCY is not responsible for any loss of data or damage to its software system. PMCY is not obliged to provide any service, data or information or create any legal or technical conditions for the use of the Website.
11.4. You assume responsibility for the proper and lawful observance of the terms of the IQOS CLUB and the use of the Website, as well as access to it by your own means. PMCY provides the Website as is and is not liable or provide any guarantees regarding: (i) proper functioning of the Website; (ii) possibility of access and use; (iii) completeness and accuracy of the content, information and data of the Website; (iv) absence of errors in the Website and its content, and, more specifically, absence of viruses and other malicious software. In particular, PMCY is not liable for any improper or faulty operation of the IQOS CLUB Website if such operation is due to circumstances beyond its control or force majeure events (including, without limitation, any technical or other problems in the telecommunications network). To the fullest extent permitted by applicable law, you understand and agree that neither PMCY, nor Philip Morris International, nor any of its affiliates, nor third party content providers are liable for any damage related to or arising from the use or failure to use the CLUB or the Website or any other website accessed through a link from the Website. In any case, you acknowledge, by accepting these General Terms and Conditions, that the content you access through the Website does not constitute and should not be understood or construed as a claim on health issues, medical instruction or recommendation. For health issues you should consult your physician. PMCY is not liable for any damage that may have been incurred by any Member or any third party, due to or in relation to the information obtained from the Website maintained by PMCY or posted on it.
If you download or use material from this Website, you should do so at your own discretion and risk. You are solely liable for any damage to your computer or loss of data resulting from downloading or using any material.
11.6. This Website includes logos and other trademarks and service marks that are the property of PMCY, PMI or third parties under a relevant license from such third parties. All such trademarks are the property of their respective owners and you agree not to use or display them in any manner whatsoever without the prior written permission of the respective trademark owner.
11.7. PMCY will make every reasonable effort to ensure the good maintenance and availability of the Website. However, the availability of the Website may be affected by the equipment used by its users/visitors/members, the state of communication networks, the number of people trying to use the Internet at the same time or other causes and, therefore, the Website may not function well or at all or may require maintenance without any notice.
11.8. PMCY takes all reasonable measures to prevent unauthorized access to the Website. However, you must also take all possible precautions to avoid use of the Website by unauthorised persons, such as avoiding making use of the website in the presence of these persons (e.g. minors, vulnerable groups in relation to tobacco products, etc.) or leaving the Website open and/or without your supervision in front of such persons.
11.9. The use of the IQOS CLUB Website by persons under the age of 18 is strictly prohibited.
11.10. The Website may contain links to third party websites which are not under the management or control of PMCY. PMCY does not control the nature and content of these websites, is not liable and accepts no liability for any information or opinion contained in any third party website. The inclusion of links to third-party websites does not constitute an endorsement of the material on those websites nor any association with them. Please ensure that you read the terms of use and privacy policies of any websites you may visit.
11.11. PMCY takes every possible precaution so that your account details that reflect your interaction with the IQOS CLUB (e.g. number of points collected, type of coupons and their status, etc.) are correct, accurate and up-to-date, but is not liable for any error or deviation during the recording thereof either by you or when such error or deviation arises from information received from its partners (e.g. use of coupons at Partners).
12. Your obligations in the IQOS CLUB
12.1. If you cause a technical outage to the Website, you agree that you will be liable for any and all damages, costs and expenses (including attorneys' fees and court expenses) arising from or caused by such outage. You agree to indemnify, defend and discharge PMCY, the companies of the Philip Morris International Group and its directors, executives, employees, consultants, agents and associates from any and all third party claims, liability, damages and/or costs arising due to or from any culpable, illegal or non-contractual use of the Website by you or any culpable breach on your part of any IQOS CLUB Terms and Conditions. In any case, you must promptly inform PMCY at: contact.cy@iqos.com or using the toll-free telephone number: 800 088 03 (charges depend on the communication provider) if you become aware or you have reasonable suspicions or indications that any illegal or non-contractual use of the Website has been made (even due to your negligence), in order for PMCY to be able to take the necessary measures to mitigate any damage.
12.2. You must observe confidentiality obligations and you must refrain from using the IQOS CLUB, the programs and Privileges and Coupons, as well as the Website in an illegal, vulgar, offensive or obscene manner. Use of the Website is granted only if you act in a fair and lawful manner, and refrain from any action that causes or may cause damage to the reputation of PMCY, or cause any undesirable exploitation thereof. The creation of any link that insinuates any kind of relationship between the User/visitor/third party and PMCY, or approval or support by PMCY when there is none, is prohibited.
12.3. IQOS CLUB Member access details cannot be assigned to third parties, in order to prevent unauthorized access to Members' accounts. Each Member is obliged to take measures to keep the username (email address) and the corresponding password confidential. Each Member must immediately notify PMCY if the Member believes that (i) their username and password are being used by a third party; or (ii) there is a risk that their username and password may be used by another person without permission.
12.4. Members are liable for all actions performed using their username (email address) and password. PMCY is not liable for any damages, including damages and lost profits, resulting from the intentional or unintentional disclosure of your password and/or username (email address) to third parties.
13. Amendment to the IQOS CLUB terms
PMCY is entitled to amend the IQOS CLUB terms, in whole or in part, at any time. It is also entitled (without limitation) to extend or shorten the respective periods, to set new periods and new conditions, to change procedures, programs and privileges, to add or remove them and, in general, to proceed to any amendment to the conditions and restrictions of the CLUB and its procedures at its own discretion. In case of amendment to the terms, you will be informed in any reasonable manner, such as through the IQOS CLUB Website, or by other personal communication, if possible, and/or by public postings by PMCY.
Your acceptance of the terms and/or your continued participation in the CLUB (access to the CLUB Website, redemption of coupons, etc.) will be deemed as acceptance of any amended terms of the IQOS CLUB.
14. Other provisions
14.1. PMCY reserves the right to temporarily suspend or terminate Members’ rights in case of abusive use of the IQOS CLUB. In addition to temporarily suspending or terminating the rights to use the IQOS CLUB, PMCY is entitled to take the appropriate administrative and/or legal measures it deems necessary to compensate its damages resulting from the abusive use.
14.2. Any failure by PMCY to implement these General Terms and Conditions is not deemed to be a waiver of the General Terms and Conditions or their individual provisions.
14.3. PMCY is not liable for any Member's claim arising from incorrect or misleading information the Member has received if such information is not part of a communication from PMCY.
14.4. If any of the terms are declared to be illegal, invalid or unenforceable, such terms will be separated from these General Terms and Conditions and the rest of the terms will remain in full force and effect.
14.5. The General Terms and Conditions constitute the entire agreement between PMCY and the Members in relation to the IQOS CLUB and the use of the Website and supersede all previous agreements and understandings with respect thereto. The individual terms in relation to coupons, competitions, programs, Privileges, etc. continue to apply alongside these General Terms and Conditions. The information mentioned on the Website constitutes an integral part of the agreement and cannot be not amended without an express agreement between the contracting parties (e.g. express agreement by exchange of emails).
14.6. PMCY may amend the General Terms and Conditions from time to time and the new terms enter into force upon their posting on cy.iqos.com.
14.7. All matters concerning the entry into force, amendment and termination of the General Terms and Conditions are governed by the applicable law of the Republic of Cyprus.
14.8. Disputes arising in relation to actions, performance and liabilities of the parties in relation to the General Terms and Conditions shall be referred for resolution to a competent Court of the Republic of Cyprus.
