1. Application of these Terms – Eligibility for Participation

1.1 These terms and conditions (the "Terms") apply to your participation in the program titled αντΑΛΛΑΖΟΥΜΕ ("αντΑΛΛΑΖΟΥΜΕ") to upgrade your heated tobacco device [IQOS 2.4+ or IQOS 3 or IQOS 3 MULTI or IQOS 3 DUO or lil SOLID or lil SOLID EZ] ("Device" or "Eligible Device") to an IQOS ILUMA or ΙQOS ILUMA ONE («IQOS ILUMA or IQOS ILUMA ONE»)Please read these Terms carefully as they affect your rights and govern your relationship to this program with PHILIP MORRIS CYPRUS LTD, a company with registered office at 23 Kennedy Str., 1075, Nicosia, Cyprus, and with registration number HE420512 (hereinafter referred to as "PHILIP MORRIS").

1.2 You shall have the opportunity to participate in the "αντΑΛΛΑΖΟΥΜΕ" program under the following cumulative conditions:

(a) You are over the age of 18, a user and owner of any Device among those detailed in Clause 1.1 above.

(b) You and your Device are registered in the PHILIP MORRIS Adult Consumer Database.

(c) Your main residence is in Cyprus.

(d) Your Device includes the holder and pocket charger, with the exception of the IQOS 3 MULTI and the Lil SOLID devices (which actually consists of a single unit).

PHILIP MORRIS reserves the right to set other additional minimum conditions for participation at times regarding eligibility to participate in this program and/or which are the eligible Devices, which will be publicly announced, e.g. in the https://cy.iqos.com, and/or by other physical or electronic means, at the discretion of PHILIP MORRIS (hereinafter the "Public Announcement").

1.3 In the context of the "αντΑΛΛΑΖΟΥΜΕ" program you are not obliged to own and return the charging cable, the packaging box or other accessories complementary to the Device.

1.4 As long as you are not already a registered user in the PHILIP MORRIS Adult Consumer Database, you may register, as well as register your Device in the PHILIP MORRIS Adult Consumer Database at https://cy.iqos.com or complete your registration at an IQOS store. For any additional assistance, you can call our call center."

1.5 By participating in the "αντΑΛΛΑΖΟΥΜΕ" program you agree and are bound by these Terms as posted on https://cy.iqos.com. If you do not agree or cannot comply with these Terms, you may not participate in this program.

1.6 We reserve the right to amend these Terms at any time, upon relevant notice by Public Notice, at the discretion of PHILIP MORRIS.

2. Conditions for Participation

2.1 The "αντΑΛΛΑΖΟΥΜΕ" program is available at IQOS stores and exclusive stores ("Store" or "Stores"). For further information on where the program is available, please contact our call center or visit https://cy.iqos.com.

2.2 The "αντΑΛΛΑΖΟΥΜΕ" program enables you to receive a IQOS ILUMA or ΙQOS ILUMA ONE device from a Store at a lower price, by delivering your eligible Device, under the terms and conditions of Clause 1.2 above, to the Seller of the IQOS ILUMA or ΙQOS ILUMA ONE device, subject to the terms of Article 2.9 below. Seller means a dealer of the company named Cassandra Trading Limited ("Cassandra"), which trades and distributes PMI products within the Republic of Cyprus, at a physical point of sale for IQOS products participating in the "αντΑΛΛΑΖΟΥΜΕ" program, as these points are defined in Clause 2.1 above.

2.3 In particular, the following currently apply:

Description of Eligible Device: IQOS 2.4 or IQOS 2.4+ or IQOS 3 or IQOS 3 MULTI or IQOS 3 DUO or lil SOLID or lil SOLID EZ (operational or out of order)

IQOS ILUMA Device Discount: DEVICE IQOS ILUMA ONE+2 Packs (from 39€ to 29€) or DEVICE IQOS ILUMA+2 Packs (from 69€ to 49€)

PHILIP MORRIS reserves the right to modify the above at times freely and at its discretion, following Public Announcements In any case, you will be informed of the current discount at https://cy.iqos.com, and/or by other physical or electronic means, at the discretion of PHILIP MORRIS.

2.4 Devices with the following characteristics shall not be accepted to be replaced under the "αντΑΛΛΑΖΟΥΜΕ" program:

i) Devices in which the serial number has been modified, distorted, or deleted.

ii) Devices that have been opened, serviced, modified or altered in any way that is not authorized by PHILIP MORRIS

iii) Devices not mentioned in Article 1.1. above.

2.5 The price reduction which is calculated in the manner mentioned in Article 2.3 above shall be valid at the time of your visit to any Store, for the purchase of an IQOS ILUMA or IQOS ILUMA ONE device. In case you do not proceed with a purchase during the aforementioned period and/or you do not participate in the "αντΑΛΛΑΖΟΥΜΕ" program, and you wish to participate in this program at a later date, then the price reduction shall be determined depending on the price reduction applicable at the time of your next visit to the point of sale, subject to article 2.3 above.

2.6 You may participate in the "αντΑΛΛΑΖΟΥΜΕ" program up to 1 time per calendar year throughout the term of the program for the purchase of one IQOS ILUMA or ΙQOS ILUMA ONE device.

2.7 It is also noted that the return of an eligible Device, in accordance with Article 2.2., of a specific color (in particular, but not exclusively, colors that are deemed as limited edition) does not oblige the Seller and the Seller does not guarantee to you to secure a reduced price for you for the purchase of an IQOS ILUMA or ΙQOS ILUMA ONE device of the same color.

2.8 When the return of the Device through the "αντΑΛΛΑΖΟΥΜΕ" program has been completed, your Device will be sent for recycling. Therefore, the Seller will not be able to return to you, the Device that you have replaced. This term is an essential condition for your participation in the "αντΑΛΛΑΖΟΥΜΕ" program.

2.9 Participation in this program shall be subject to the availability of the IQOS ILUMA or ΙQOS ILUMA ONE device.

2.10 We are entitled to refuse your application to participate in the program or to discontinue your participation for any reason, including any breach of these terms or any unlawful conduct you may exhibit.

3. Term of the "αντΑΛΛΑΖΟΥΜΕ" program

The term of the "αντΑΛΛΑΖΟΥΜΕ" program is set from 12 December 2022 to 31 December 2024. PHILIP MORRIS reserves the right to extend the term of the "αντΑΛΛΑΖΟΥΜΕ" program. Any change during the term of the aforementioned program will be announced by a Public Announcement.

4. Final provisions

4.1 PHILIP MORRIS and/or Sellers shall be liable to the fullest extent permitted by applicable law either for tort (including negligence or breach of legal obligations) or due to breach of contract, error, or from any form of compensation for direct or indirect damages, loss of profits, sales, revenues or savings, loss of business, reduction of goodwill and/or similar losses or loss or alteration of data or information, or net financial loss, or for any special, indirect or consequential loss, cost, damage, charges or expense caused by of or otherwise arising from your participation in the "αντΑΛΛΑΖΟΥΜΕ" program.

4.2 Personal Data Processing: When you participate in the "αντΑΛΛΑΖΟΥΜΕ" program PHILIP MORRIS will process your personal data in the manner described in the Privacy Policy. We implement appropriate technical and organizational measures to protect your personal information that we keep from unauthorized disclosure, use, alteration or destruction. Where appropriate, we apply encryption methods and other technologies that support us in securing the information you provide to us. In addition, the Company, through corresponding contractual commitments with its partners, takes all necessary security measures so that the latter will comply with a strict framework of protection and security of your personal data. In all other cases of sale of Products from physical stores, Sellers will process your personal data in the context of the implementation of these terms of the program, in accordance with their own privacy policy and under their own responsibility.

4.3 These terms do not in any way modify the applicable terms of purchase which continue to apply cumulatively with these terms for the purchase of the IQOS ILUMA Ή IQOS ΙLUMA ONE device under this program. Furthermore, this program does not replace the applicable legal or commercial guarantees of the IQOS ILUMA ή IQOS ΙLUMA ONE Devices provided at times by PMI and which continue to apply as specified in the relevant terms.

4.4 These Terms are subject to the laws of the Republic of Cyprus. Any legal dispute shall be subject to the exclusive jurisdiction of the Courts of Cyprus.

TERMS OF THE IQOS MORE DISCOUNT CODE


1. The IQOS MORE Application (hereinafter “the Application”) is owned by the company PHILIP MORRIS CYPRUS LTD, having its registered office at Kennedy 23, , 1075, in Nicosia, Cyprus, with registration number HE420512 (hereinafter the “Company”). If you wish to be informed about the IQOS product and receive the IQOS MORE discount code, you must have been referred by an IQOS User, who is already registered in the Application as detailed below.

2. If you have been referred by an IQOS User, then you will receive a relevant SMS and have acquired the right to purchase a Ready to Go Kit IQOS at a preferential price, within thirty (30) calendar days from receiving the SMS and/or email, provided that you register at IQOS database.
If you do not make the purchase within that time limit, the code will be automatically deactivated.

3. As you have already been orally informed by the IQOS adult user who entered your personal details in the Application after communicating with you, so that we can send you the SMS and/or email, the terms applicable to the acquisition and use of your discount code are as follows:

The discount code is intended only for adult smokers who have not purchased any IQOS product in the past. If you do not meet the above conditions, you are kindly requested to state so immediately to the Company’s associate who will contact you and to abstain from registering in IQOS MORE.

The discount code is personal and non-transferrable, and may not be used by any other person than the person for whom the code is intended and who subsequently registered in the Application.

The Company and/or any associate thereof to whom you will appear to purchase the Ready to Go Kit IQOS by use of a discount code shall be entitled not to apply the discount, if you fail to meet any of the conditions cited under (a) and (b) above, no matter when such failure is identified.

You must first register in the Application, for the code to be sent to you. The data you will be asked to provide are your full name, your mobile phone number, as well as (optionally) your email.

Your above cited data are collected so that (i) we can send you an SMS to confirm your registration in the IQOS MORE Application and you can receive the discount code; and (ii) our partners can contact you to inform you about the Ready to Go Kit IQOS, as well as to provide you with all necessary information relating to the discount code and to where you can purchase the product. Your data will be used only for the above purpose and will be deleted within thirty (30) calendar days as of the date you receive the code, if you do not use it. If you use the code and purchase the IQOS Ready to Go Kit, we will retain only those data related to the use of your code and the purchase of the product at a discount.

You are obliged to provide true and correct data to us, as well as to confirm that you are an adult smoker.

Before completing your registration, you will view the data entered by the adult smoker who personally informed you about the Application, so that you confirm them. If you find out any mistake, you must state so and correct it; otherwise, if a mistake is subsequently identified, clause (c) above shall be applicable.

By stating your personal details and completing your registration in the IQOS MORE Application, you agree to the terms of acquisition and use of the discount code, of which you are hereby notified.

Nevertheless, your registration and the acquisition of the discount code will be activated only after you have received an SMS confirming your registration on your mobile phone. You may opt out, by following the instructions provided in the SMS you will receive (namely, by sending an email at contact.cy@iqos.com or by calling at 8000 8803).

Within a short time period (within 48 hours) as of receiving the above SMS and provided that you have not previously opted out of the Application, an associate of the Company will contact you to provide you with more information about IQOS and its points of sale. Even if you haven’t opted out as per above, you may state directly to the associate who will call you that you don’t wish to have that communication.

However, you are in any event entitled not to use the discount code, which will automatically expire upon lapse of thirty (30) calendar days from receiving the above SMS.

(m) By showing the discount code you are entitled to get IQOS Iluma One or IQOS Iluma or Ready to go IQOS Iluma Prime Kit with 10€ discount.

4. Your above cited data are collected by third-party associates of the Company, acting on its mandate and behalf for the above mentioned purposes. Moreover, the Company uses distributors, associates and subcontractors in general under this program in order to contact you after your registration and for the sale of its products.

5. You maintain the right to access your data, and to object to the use of your personal data, in accordance with the provisions of the data protection laws, at any time, both to rectify them and to erase them, by contacting the Company at contact.cy@iqos.com

6. The Company maintains the right to modify, at any time and with future effect, these terms, the duration and the conditions of the discount code and anything related to this program, by an announcement on its website (www.iqos.com) and/or by sending you information by email or SMS using the contact details you have provided.
