TERMS OF COMMUNICATION WITHIN THE Member Get Member

Member Get Member Terms ("Program")

1. Brief Program Description

Responsible for the Program is the company with the name "PHILIP MORRIS CYPRUS LTD" based in Foti Pitta, no. 4, 12th floor, 1065, Nicosia with no. HE42051, (hereinafter "PMCY", the "Company" or "We").

You can join the Program in the following ways:

a) If you received an sms on your mobile phone, it is because you told an adult IQOS consumer friend that you wish to be informed about Philip Morris' new tobacco products (non-smoking tobacco products such as new tobacco products under the trade name IQOS – "the Products"). Since you have received an sms on your mobile phone, you are invited, if you wish, to confirm your details, to give your consent, if you wish, to receive commercial communication in relation to the Program and take part in the Program to inform you in more detail about the Products.

b) If an adult friend of yours directly gave you an "IQOS CODE" himself or informed you that you can use his mobile number as a "MOBILE CODE" it is because you told him that you are interested in coming to be informed yourself at a retail point sale (physical or online store) or call the IQOS Customer Service Center yourself on 8000 8803 (toll free) from Monday to Friday from 09:00 to 21:00 and Saturday from 10:00 to 18:00 (hereinafter collectively "the Contact Numbers")

2. Deadline for activating consent if you received an sms:

Since you have received an sms on your mobile phone, you have 30 days since you received the sms to activate the link (by clicking on the relevant link to activate). In case you did not activate the link within the specified period, the link will no longer be active, your data will be deleted and you will not receive any additional communication.

3. Deadline for use of codes:

a) if you activate the link within the deadline, you will also receive a code to use to purchase a Product, if you wish. The code can be used within the time remaining for the expiration of the above deadline, since you activated the link,

b) if your friend has directly given you an IQOS CODE or his mobile number as a MOBILE CODE, then you can use it when you come to the retail outlet or call the Customer Service Center (hereinafter collectively referred to as the "Codes")

4. What are these Codes and what restrictions apply:

4.1 The code you receive on your mobile, as well as the IQOS/MOBILE CODE your friend gives you, is unique to him. The Code is used so that if you use them in the event of a purchase, we can give him (your friend) a reward for the Program according to its terms.

4.2. Each Code is intended for use only by you who received it under the terms and restrictions herein and may not be further transferred by you to third parties or used by others. We reserve the right to request that you show us any identifying information deemed necessary to confirm your personal use. It is also expressly and unequivocally forbidden to provide information about the specific program or the codes, as well as their use in general by minors.

4.3. In the event that you change your mind and are no longer interested in the Program, we invite you to delete the sms you received completely from your mobile phone and/or do not use the IQOS/MOBILE CODE your friend gave you. 4.4. We reserve the right to set restrictions on the right to use the Codes, both in terms of the period of their use and in terms of the number of people who can use it (a limit that will be announced each time to your adult friends). Any rewards are also awarded to your adult friend based on these limits and restrictions.

5. Right to Withdraw Consent for Communication from Our Partner - No Obligation to Purchase:

5.1. You can withdraw your consent at any time by contacting the IQOS Customer Service Center or via email at contact.cy@iqos.com. This will stop (or not start) communication with you. You do not lose any right to purchase a product by withdrawing consent for communication (you can always use the Code within the deadline mentioned in Article 2 above, if you wish).

5.2. It is noted that neither receiving the Codes nor activating the link you receive imposes any obligation on you to purchase products or use the Codes. It is at your discretion whether to use the Code you receive, even if you eventually make a purchase, always according to the terms and restrictions of this document.

6. To Whom This Is Addressed:

6.1. This is addressed only to adult smokers who have not purchased a Product before and have expressed interest to an adult smoker friend to be informed about the Products as a new tobacco product, duly by our Company, either by visiting a retail point (physical or online) or by calling the Customer Service Center. IF THE ABOVE CONDITIONS ARE NOT MET, WE INVITE YOU TO DELETE THE SMS OR THE IQOS CODE AND NOT TO USE IT. 6.2. Products are new tobacco products that are not an alternative to quitting smoking and are not designed as a cessation aid, are not risk-free, contain nicotine which is addictive, and are intended exclusively for use by adult smokers. Further information on the risk is available on the website www.iqos.cy. Proper information for adult smoker consumers about the Products can only be provided by our Company through its partners or at their retail points (physical or online).

6.3. If we find or have indications at any time that the criteria and terms of this document are not met, we can refuse or discontinue any communication or use of the Codes.

6.4. To provide your consent and receive communication, you must provide your friend with correct and truthful information. You should also refrain from wilful alteration or modification of this information or providing outdated or false information. 6.5. IF YOU RECEIVED THE SMS BY MISTAKE DUE TO AN ERROR IN YOUR DETAILS, WE INVITE YOU TO DELETE THE MESSAGE COMPLETELY. ALSO, IF YOU WERE MISTAKENLY INFORMED ABOUT THE POSSIBILITY OF USING THE IQOS/MOBILE CODE, WE INVITE YOU NOT TO USE IT. If the adult consumer who provided your details does not belong to your social circle and/or failed to inform you properly and in detail as mentioned herein or violated any of their obligations as described and communicated to you in these Terms, we invite you not to take any action or use the Codes and to inform our Company at the IQOS Customer Service Center at 8000 8803 (toll-free) from Monday to Friday, from 09:00 to 21:00, and Saturday from 10:00 to 18:00. In all the above cases, if you wish, you can also inform our Company at any time using the Contact Details provided.

7. PMCY’s Responsibility:

PMCY relies in good faith and reasonably on the statements provided by the adult consumer of Products during the collection of your data for entry into the Program to send the invitation to your mobile phone for link activation (where this process is provided above). It also relies in good faith and reasonably on the confirmations and guarantees provided by the adult consumer of Products when declaring your details, as well as on the statements you provide during your participation in the Program and the consents you give that you are an adult smoker and that your details are true and correct. Our Company is not liable for any violation of the above if it is due to an act or omission by your friend or yourself, and we reserve the right to take action against you or any third party causing any damage to the Company due to or in connection with the above. If, despite the procedures and care we take for the lawful and correct collection of your data, you received the invitation for link activation by mistake or error, please ignore and delete it immediately. In any case, our liability, where permitted by law, is limited to covering any proven direct damage you may suffer that is causally related to any culpable act or omission on our part within the framework of this specific Program, subject to the above.

8. Miscellaneous:

8.1. f any term is deemed abusive, this does not affect the validity of the remaining terms, which continue to apply normally. Delay in exercising any right of PMCY or showing any tolerance does not imply a waiver of that right, which may be exercised at any time and later. 8.2. Our Company reserves the right to modify these terms at any time, change the procedures for executing the Program, discontinue or change the use of any Code, and make any changes with a simple announcement through its website iqos.cy or any other means deemed necessary.

9. Dispute Resolution

Any dispute arising in connection with the Competition will be referred exclusively to the District Court of Nicosia and will be governed by the Law of the Republic of Cyprus.
